MDMA Sales / Molly Sales
Under Florida law, it is a felony to sell any substance that has been listed as a Controlled Substance, including MDMA or Molly. A person arrested and charged with Sales of MDMA can be facing up to 30 years in prison, based upon the weight of the MDMA and where the sale took place.
Florida law makes the crime more serious if it happened within a 1000 feet of a park, a school, a church, a convenience store, among other places. Police know this well and it’s common for Miami police to use undercover agents and confidential informants to arrange for MDMA sales in these very places.
We have represented defendants who tried to sell police narcotics, and who the police sent back to meet again, only this time with more drugs and this time closer to a school.
Police also know the same things you do – that Molly is available at almost every Miami nightclub, South Beach nightclub, or Miami area music festival. EDM and MDMA go hand in hand in South Florida, and so do arrests.
Undercover agents and confidential informants are the bread and butter of Miami police work when it comes to drug sales. If you are involved in drugs, one way or another, you probably know someone who has legal trouble. And it’s very likely that person is only back on the streets because they have agreed to work on behalf of the same police that arrested them.
These are the people the police will use to build a case against you. They will use your phone calls, your text messages, and any other evidence they can gather – even the testimony of your friends.
Whatever drug evidence they seize from you they will send to a laboratory. It doesn’t matter how pure it is. If it is even one percent illegal, they will count the entire weight against you. The good news is that the laboratories are often very backed up, and this can provide your attorney a chance to speak to the prosecutors before results arrive. What’s more, the police will schedule what is called a “Pre File Conference” with the prosecutors. If your lawyer speaks to them first, they will know your side of the story and whatever facts are good for you.
If you or a loved one is facing this kind of charge, it is important that you call Grant Dwyer, an experienced Miami MDMA sales attorney, as soon as possible. We can tell you the best ways to beat your case. Don’t waste any time.
